Spare Paddle Holder – Safety Notice, Terms of Use & Limitation of Liability
Effective Upon Purchase and Use
The K&K Canoe Accessories Spare Paddle Holder is an accessory designed to assist with the storage of a spare paddle. It is not a life-saving device, structural component, or safety system.
By purchasing, installing, or using this product, you acknowledge and agree to the following:
1. Inherent Risk of Paddling Activities
Canoeing, outrigger paddling, and all related water activities involve inherent and unpredictable risks, including but not limited to:
- Capsizing
- Collision with objects or other vessels
- Surf, current, or weather-related forces
- Equipment failure
- Serious injury or death
These risks exist regardless of equipment used.
2. Proper Use Requirement
This product must be:
- Installed correctly
- Used only for its intended purpose
- Inspected regularly for wear, UV degradation, corrosion, cracking, fraying, or hardware fatigue
The Spare Paddle Holder is not designed to secure paddles under extreme forces such as surf impact, shore break, capsizing, or high-speed collisions.
3. No Product Modification
Any modification, alteration, misuse, or improper installation voids all responsibility of K&K Canoe Accessories and may result in product failure.
4. User Responsibility
The user assumes full responsibility for:
- Determining product suitability for their canoe and paddling conditions
- Ensuring proper installation
- Ongoing inspection and maintenance
- Safe paddling practices
Failure to follow safe practices may result in equipment loss, injury, or death.
5. Assumption of Risk
Use of this product constitutes voluntary assumption of all risks associated with paddling and related activities.
6. Limitation of Liability
To the maximum extent permitted by law, K&K Canoe Accessories, its owners, employees, affiliates, and distributors shall not be liable for:
- Personal injury or death
- Loss of paddles or other equipment
- Vessel damage
- Property damage
- Incidental, indirect, or consequential damages
arising from the use, misuse, installation, failure, or inability to use this product.
7. No Warranties Beyond Stated Terms
Except where required by law, this product is provided “as is” without guarantees of performance under all conditions.
8. Discontinue Use if Damaged
Do not use the holder if any component shows:
- Cracking
- Fraying
- Deformation
- Hardware failure
- Loss of elasticity or structural integrity
Replace immediately.
If you do not agree with these terms, do not use this product.
